STRAUNT LLC, formed on April 25, 2022, with its principal working office at 8600 Freeport Pkwy, Ste 130, Irving TX 75063 (“Straunt,” “we,” “us,” or “our”) recognizes the importance of protecting the privacy and security of your personal information. This Privacy Policy (“Policy”) explains how we collect, handle, and protect your data when you interact with our platform, which includes our restaurant management system, website https://straunt.ai, and related platforms (collectively, the “Services”). By engaging with our Services, you consent to the data practices described in this Policy. Should you disagree with any terms of this Policy, we kindly ask that you refrain from using our Services.

INFORMATION WE COLLECT

a) Contact Information:

When you sign up to use the Services or interact with us, we may collect personal information, such as your name, address, phone number, email address, or similar identifiers (“Contact Information”). We only collect Contact Information when you provide it voluntarily.

b) Demographic Information:

We may collect demographic information, which may include protected characteristics under state or Federal law, such as age, date of birth, gender, or disability status.

c) Billing Information:

To process orders through the Straunt platform, we may require certain billing information in addition to the Contact Information, such as debit card or credit card details, billing address, expiration date, security code, and any other financial information (“Billing Information”).

d) Commercial Information and electronic activity information:

We may collect records of personal property and products or services that you have purchased, obtained, or considered. We may also collect information on your browsing history, search history, and information about your interactions with the Services.

e) Geolocational Information:

To provide location-based services, we may collect geolocational information from your mobile device or through third-party service providers (“Geolocational Information”). This information is collected only when the Services are in use on your mobile device, and you can control the collection of Geolocational Information through your device settings.

f) Other Information:

In addition to Contact Information, Billing Information, Geolocational Information, and inferences drawn from any of the categories above, we may collect other information related to your use of the Services, interactions with us, and your devices (“Other Information”). This may include:

Additional information voluntarily provided by you, such as food orders, preferences, biometric information (e.g., fingerprints, voice recordings) and sensitive personal information, such as account log-in and password.
Information automatically collected when you use the Services, such as device information (e.g., device type, operating system), IP addresses, browser type and language, referring and exit pages, and usage patterns.
Information collected through cookies, pixels, web server logs, and similar technologies to personalize your experience, analyze usage patterns, and improve the Services. You can manage cookie preferences through your browser settings.

Information obtained from third-party sources, including social media platforms, in accordance with their terms of use and privacy policies.
We may also derive inferences or create profiles based on the collected information to understand preferences, behavior, and trends.


USE OF COOKIES

The Straunt website uses “cookies” and similar web tracking technologies to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a webpage server. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Straunt. services or websites you visit.

HOW WE USE YOUR INFORMATION

We use your personal information for the following purposes:

  • Communicating with you, including contacting you about our products or responding to your inquiries.
  • Providing and supporting the Services, including user communication, account management, customer service, and system maintenance.
  • Analyzing and improving the Services, such as understanding usage patterns, monitoring effectiveness, and developing new features and functionality.
  • Personalizing your experience, recommending nearby restaurants, and administering rewards and promotional programs.
  • receiving services from providers in support of our business, investigating and preventing fraud, conducting audits, or identifying potential customers and investors.
  • Protection of ourselves or others, including protecting against malicious, deceptive, fraudulent, or illegal activity, or protecting our rights and those of our consumers or investors and defending any claims made against us. 
  • Complying with legal obligations, protecting our rights and interests, and preventing fraudulent or illegal activities.
  • Any other purpose disclosed to you at the time of collection or with your consent.

HOW WE SHARE YOUR INFORMATION

We may share your personal information with the following parties:

  • Service providers and business partners who assist us in delivering the Services and supporting our operations.
  • Law enforcement, government agencies, or authorized third parties to comply with legal obligations or protect our rights and the safety of our users.
  • Third parties in the event of a merger, acquisition, or sale of assets, subject to confidentiality obligations.
  • To any third party with your prior consent 
  • We do not sell your personal information to third parties. However, we may share aggregated or anonymized data that does not identify you personally.

Legal Disclosures : In accordance with this Agreement and applicable law, we may disclose User information pursuant to a subpoena, court order, warrant, or other legal process. We may also disclose User information if we, in good faith, believe such disclosure is necessary to: (i) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (ii) investigate and defend ourselves against any third-party claims or allegations; or (iii) protect the security or integrity of our Service.

To ensure the legitimacy of such requests, we will use commercially reasonable efforts to validate them, such as by requesting a call back from the requesting party or requiring law enforcement officials to present themselves at our offices, except in urgent or critical circumstances. There may be exceptional circumstances where we disclose User information to law enforcement agencies without informing you beforehand. These circumstances are limited to situations where there is an immediate threat to public safety or a life-or-death emergency. We will attempt to notify Users about legal demands for their personal information when permitted by law and not prohibited by a court order or when the request is related to an emergency situation. We reserve the right to dispute such demands when we believe, in our sole discretion, that the requests are overly broad, vague, or lack proper legal authority, but we do not promise to challenge every demand.

HOW WE PROTECT YOUR INFORMATION

We implement appropriate technical and organizational measures to protect your personal information from unauthorized access, use, disclosure, alteration, or destruction. We maintain industry-standard security practices and regularly review and update our security measures to ensure the ongoing confidentiality, integrity, and availability of your personal information.   • request a copy of your personal information;
  • correct the personal information we hold about you; 
  • request deletion of your personal information, as further explained below;
  • opt-out of “sharing” of personal information for “cross-contextual behavioral advertising” purposes (as these terms are defined under applicable law);
  • opt out of targeted advertising; 
  • opt out of certain profiling activities; 
  • ask that we provide your personal information in a format that would facilitate its transfer to another organization, or to you, in certain circumstances (referred to as the right to data portability); and
  • not be unlawfully discriminated against for exercising your rights.

These rights may be limited or denied in some circumstances under applicable local law. If we deny a request, we will explain why in accordance with applicable local law.

RETENTION OF PERSONAL INFORMATION 

We will retain your personal information for as long as necessary to fulfill the purposes for which we collected it, to satisfy any applicable legal, accounting, or reporting requirements; to establish, exercise, or defend legal claims; or for our legitimate purposes. If we hold your personal information as a processor or service provider, then we retain that information in accordance with our customers’ instructions. Any request to delete your personal information is subject to these obligations and restrictions. 

CHILDREN’S INFORMATION

The Services are not intended for use by individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16 without parental consent, we will take steps to delete such information. If you believe that we may have collected personal information from a child under 16, please contact us using the information provided in Section 18.

EXTERNAL WEBSITES AND PAYMENT SERVICE PROVIDERS

The Services may contain links to external websites or services that are not operated by Straunt. We are not responsible for the privacy practices or content of these third-party websites or services. We encourage you to review the privacy policies of any third-party websites or services that you visit.

When you make payments through the Services, your payment information may be processed by third-party payment service providers. We do not store or have access to your complete payment card details. The processing of your payment information is subject to the terms and privacy practices of the payment service provider. We recommend reviewing their privacy policies and terms of service before providing any payment information.

ACCESSING AND MODIFYING INFORMATION AND COMMUNICATION PREFERENCES

You have the right to access, update, correct, and delete your personal information stored by us, subject to applicable laws. You can exercise these rights by contacting us using the information provided in Section 18. Please note that we may retain certain information as required by law or for legitimate business purposes.

You can also manage your communication preferences by opting out of receiving promotional emails or notifications through the settings in your account or by following the unsubscribe instructions included in the communication.

DO NOT TRACK

The Services do not respond to “Do Not Track” signals. However, you can set your browser to refuse certain cookies or to alert you when cookies are being sent. Please refer to your browser settings for more information on how to manage cookies.

NOTICE TO CALIFORNIA RESIDENTS

If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA). Please refer to our separate California Privacy Notice for information about your CCPA rights and how to exercise them.

NOTICE TO NEVADA RESIDENTS

If you are a Nevada resident, you have the right to opt-out of the sale of your personal information. We do not sell your personal information as defined by Nevada law. IMPORTANT NOTICE TO NON-U.S. RESIDENTS

The Services are operated in the United States. If you are accessing or using the Services from outside the United States, please be aware that your personal information may be transferred to, stored, and processed in the United States, where our servers and databases are located. The data protection laws of the United States may not be equivalent to those in your country. By using the Services or providing us with your personal information, you consent to the transfer, storage, and processing of your personal information in the United States.

UPDATES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will post the updated version of the Privacy Policy and indicate the effective date at the beginning of the Policy. We encourage you to review the Privacy Policy periodically. Your continued use of the Services after the effective date constitutes your acceptance of the updated Privacy Policy.

GOVERNING LAW AND JURISDICTION

This Privacy Policy and any disputes related thereto shall be governed by and construed in accordance with the laws of the State of Texas, United States, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, this Privacy Policy or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, specifically located in Dallas. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
